II. General terms and conditions of access and use of our website.
User
The use of this Website, including the different services that EMPRESA DE ALUMBRADO ELÉCTRICO DE CEUTA DISTRIBUCIÓN, S.A. (hereinafter EAECD) offers through subscription to them (hereinafter Subscription Services) in the Private Area, attributes to you the condition of user of the same and expresses your full and unreserved acceptance of each and every one of the General Conditions published by EAECD in the Legal Notice at the very moment in which you access the Website, without prejudice to the acceptance of the particular conditions that, where applicable, are applicable. Any use other than that authorized is expressly prohibited, and EAECD is authorized to deny or withdraw access and use of the Web and Subscription Services, at any time and without prior notice, to those users who fail to comply with these general conditions or the specific conditions that may apply.
Modifications
EAECD reserves the right to modify, unilaterally, at any time and without prior notice, these conditions. In these cases, they will be published and notified as far in advance as possible. Likewise, it reserves the right to modify, unilaterally, at any time and without prior notice, the presentation and configuration of the Web.
Access and use of the Web
In general, access and use of the Web is free for users and does not require prior registration by the user. However, access to the Subscription Services offered through the Web can only be done after prior registration by the user in the Private Area and will have the cost of the service provided, of which the user will be informed prior to registration. This cost will be reviewed annually. The User undertakes to make diligent use of said registry and not to make his/her username and password available to third parties, except with his/her express authorization, as well as to inform EAECD as soon as possible of the loss, theft or any risk of access to them by a third party. The User will be responsible for granting said authorization or delegation as well as for the use of the information that the representative makes of it, for which reason EAECD is exonerated from any liability for this concept.
Payment gateway
This website has a payment gateway by credit or debit card with which payment for certain services can be made. Regarding transaction security, the payment gateway at the time of making the payment, a redirection is made to the virtual gateway or POS of the Banking Entity, which will be in charge of requesting the card number and the security data associated with it. Therefore, in no case are the card numbers of the users or the security data associated with it stored by EAECD. The payment gateway included in the EAECD website works with the highest security guarantees, ensuring the confidentiality of communications and incorporating the necessary mechanisms to ensure the authenticity of the origin and destination of transactions, avoiding their rejection and ensuring the integrity of transaction data. Gateway users must, in any case, be of legal age.
Refund policy
The user has the right to a refund of the amount of the service under the following terms and conditions:
1. Cancellations must be requested in writing, by sending an e-mail that includes the code of the invoice paid, the amount, the name and surname of the payer, the date of payment and contact details (cancellations reported by any other means are not accepted).
2. The e-mail addresses where the refund can be requested based on the service paid for are the following:
• Payments made associated with Connections (supplies, movements of facilities and producers): Conexiones.edistribucion@enel.com
• Payments associated with ATR tolls: Gestion-Clientes-Singulares@enel.com
3. The amount to be refunded will correspond to the subscriber, minus the costs incurred, if applicable.
Restrictions on use
When you access our website, you are expressly authorized to view all the information contained on the page, as well as to make private reproductions of it on your computer systems, provided that said contents are for your exclusive use and are not subsequently transferred to third parties. Therefore:
1. You are not authorized to reproduce or copy, distribute, modify, transfer or publicly communicate the information contained on the website, unless you have the authorization of the owner of the corresponding rights or it is legally permitted.

6. Any infringement of the provisions of this paragraph will be considered an infringement of the intellectual property rights owned by EAECD, giving rise to the legally established responsibilities for this purpose and such action may be pursued through the administrative, civil or criminal actions, as appropriate.
Ownership of the contents
All information contained in this website, including images, graphic designs or codes in HTML, ASP .Net, JAVA script or Active X, among others, is the intellectual and industrial property of EAECD. The company has exclusive rights to exploit the aforementioned intellectual property, in any form, and in particular, the rights of reproduction, distribution, public communication and transformation. EAECD does not fully or partially transfer, nor grant any license or authorization to users regarding intellectual or industrial property rights or any other rights relating to the website. Likewise, EAECD guarantees that the contents, including intellectual property, are not of an illicit nature and do not infringe current regulations. Consequently, the contents of the website will not be xenophobic, pornographic, discriminatory, racist or in any way promote violence. In addition, EAECD will adopt the legal measures it considers appropriate to prevent any type of conduct contrary to the law or morality.
EAECD may offer the contents, functionalities or Services of this Website by developing an App, in which case the user must have the necessary technical means to access them.
Exclusion of guarantees and responsibilities
With regard to the exclusion of guarantees and responsibilities, EAECD will not be liable for:

• the performance of illicit advertising or acts constituting a crime or of a pornographic nature.
• the illegality or lack of veracity, accuracy, reliability, relevance, timeliness and exhaustiveness of the content and information transmitted or made available to users, including information and services provided by third parties or by users through the Web.
• the non-compliance or defective performance or termination for any reason of contracts made with third parties on the occasion of the provision of services through the Web.
• the incapacity of any User or the impersonation of a third party by the User.
2. EAECD shall only be liable for its own services and content directly originated by it and identified with its Copyright as a trademark or intellectual or industrial property of EAECD.
3. EAECD shall not be liable for damages of any kind that may be due to unauthorized third parties knowing the type, conditions, characteristics and circumstances of the use that users make of the Web and the services it offers.
4. EAECD shall not be liable for damages of any kind that may be due to the existence of errors in accessing or using the Web page, as well as in accessing or using its services or content, although it undertakes to avoid them, update it or correct said content. In other words, liability is excluded for the lack of availability or continuity of the operation of the Web and the services, as well as for failures in accessing the different Web pages or those from which the services are provided.

Applicable legislation and jurisdiction
All the conditions established will be governed by Spanish Law. EAECD and the user, expressly waiving any jurisdiction that may apply to them, submit to the Courts and Tribunals of the user's domicile, for any dispute that may arise from the provision of the services subject to these general conditions. In the event that the user is domiciled outside of Spanish Territory, EAECD and the user submit, expressly waiving any jurisdiction that may apply to them, to the Courts and Tribunals of Madrid (Spain).
